Energy Disclosure Service
California Assembly Bill 1103 requires disclosure of energy use for commercial buildings sold, leased or financed.  Assembly Bill 531 authorizes the California Energy Commission (CEC) to implement AB1103 and to do so, on a phased approach. The bill covers commercial (nonresidential) buildings. The property owner is obligated to disclose the U.S. EPA’s ENERGY STAR ® Portfolio Manager Statement of Energy Performance, using the most recent 12 months period of data from electric and gas utilities. The usage records must be provided by the utility companies. 

The draft regulations proposed in May, 2010 stipulate the following, for owners of commercial property within California:

1.  Disclose the U.S. EPA’s ENERGY STAR ® Portfolio Manager Statement of Energy Performance

2.  Disclose the California Energy Performance Disclosure Report. This is a custom report format within Portfolio Manager, established by the CEC. This special report must include all data necessary to generate a Portfolio Manager Energy Performance Rating. If a Rating isn’t available (certain building type categories), the report must include all the data necessary to generate a Portfolio Manager Energy Use Index.

3.  Utility companies are required to share the most recent 12 month period data directly to EPA’s Portfolio Manager within 15 days of receiving a request from the building owner.

4.  The Statement and Report must be provided whenever the entire commercial property is sold, leased or financed.

5.  If the property is a) solely occupied by the owner or b) more than 50,000 square feet, the legislation applies beginning January 1, 2011

6.  If the property is 10,000 – 50,000 square feet, the legislation applies beginning January 1, 2012

7.  If the property is less than 10,000 square feet, the legislation applies beginning July 1, 2012
